Spain offers a specific post-study job-seeking residence authorisation for non-EU graduates who have successfully completed higher education in Spain. It allows you to remain legally in the country for up to 24 months to look for a qualified job or prepare an entrepreneurial project aligned with your studies.

What the Post-Study Job-Seeking Residence Authorisation allows
If granted, this authorisation allows you to:

It is important to understand that this authorisation does not allow ordinary paid work during these 24 months, beyond strictly academic and unpaid training activities.
Who can apply for the post-study job-seeking residence?
This authorisation is designed for:
- Non-EU nationals who have completed higher education in Spain.
- Graduates of:
- Bachelor's degrees.
- Master's degrees.
- PhD programmes.
- Higher Vocational Training (FP Grado Superior).
- Official or recognised private degrees (registered in RUCT, SIGPA, etc.).
It is a different route from consular job-seeking visas for descendants of Spaniards or high-demand occupations, and from internship residence permits, which require an internship agreement or contract.
Key requirements to qualify
- Completed higher education in Spain at EQF level 6 or higher, with an official or recognised degree.
- Apply within the legal timeframe:
- Within 60 days before your student TIE expires, or
- Within 90 days after its expiration.
Filing within this timeframe automatically extends your student stay until a decision is issued.
- No criminal record in Spain or in the countries where you have lived during the previous 5 years.
- Sufficient financial means, typically at least 100% of IPREM (around €600/month, ~€7,200/year).
- Private health insurance equivalent to Spanish public healthcare, covering the entire 24-month period.
- Not having received public development or humanitarian scholarships from Spain or the country of origin.
- No irregular status or entry bans in Spain or the Schengen Area.
- No paid work during this period (with the exception of strictly academic, unpaid training).
These conditions must be carefully documented to minimise the risk of refusals and requests for additional information.
Required documentation for a complete application
Although each case has its nuances, a complete file will usually include:
- Full valid passport (ideally with at least one year of validity).
- NIE/TIE from your previous student stay.
- Official degree or certificate proving you have completed all academic requirements.
- Academic transcript, where applicable.
- Updated empadronamiento (census registration).
- Private health insurance covering the entire 24-month period.
- Declaration of sufficient financial means, with evidence such as bank statements, scholarships, sponsorship agreements or family support.
- Criminal record certificate, duly legalised and translated.
- Business project summary, if you intend to later apply for an entrepreneurship residence.
- Documentation for family members, if applying jointly.
- Legalised and sworn-translated foreign documents where required.
How the application works
- Electronic filing in Spain
The application is submitted electronically before the Delegación or Subdelegación del Gobierno in the province where you live.
- Automatic extension of student stay
If you file within the legal timeframe, your student stay is automatically extended until there is a decision.
- Assessment
The Immigration Office checks completion of studies, financial means, insurance and criminal records. No job offer or detailed business plan is required at this stage.
- Resolution
The legal maximum is 20 days. If there is no decision within that period, positive administrative silence applies.
- Validity
The authorisation is granted for 24 months and is not renewable.
What you can (and cannot) do during the 24 months
You can:
- Stay legally in Spain.
- Attend interviews, job fairs and career events.
- Undertake unpaid training or extracurricular internships.
- Build professional networks and contacts.
- Prepare and refine a business idea or project.
- Apply for the corresponding residence and work permit once you have a suitable job offer or business plan.
You cannot:
- Engage in ordinary paid employment.
- Exceed the authorised 24-month period.
- Remain in Spain after the 24 months without a new residence permit.
Proper planning during this period is essential to avoid having to leave Spain when the authorisation ends.
Transition to work or entrepreneur residence
Once you have found suitable employment or finalised a business plan, you can move to a long-term residence route:
Modification to a work residence
- The job must be related to your field of study.
- There is no national employment test (no need to prove that the job could not be filled by resident candidates).
- Fast-track processing can apply, depending on the specific category.
Modification to entrepreneur residence
- Requires a viable, coherent business plan.
- Typically a lower burden than applying directly for the standard entrepreneur permit.
- May later qualify you for an Entrepreneur Residence under Law 14/2013.
Option for EU Blue Card or Highly Qualified Professional (HQP)
If your job is highly qualified and meets salary and qualification thresholds, you may be able to move to an EU Blue Card or Highly Qualified Professional permit, which offer particularly attractive conditions for international talent.
What about family members?
Family members who were already accompanying you during your student stay can also obtain linked residence under this authorisation.
- They must prove continued cohabitation and compliance with the usual legal requirements.
- They cannot work during this period, just like the main holder.
Practical considerations and timing
- Many graduates apply shortly after finishing their studies, coinciding with the expiry of their student TIE.
- Legalisation and translation of foreign documents should be planned early, particularly criminal records and family certificates.
- A clear transition plan (employment or entrepreneurship) increases the chances of moving seamlessly into your next permit.
- If no new residence permit is obtained within the 24 months, you will be required to leave Spain.
