Whether you simply need to extend your current authorisation or want to move to a new category that better reflects your situation, Spanish immigration law offers clear procedures — but each route has specific requirements, deadlines and consequences if you get it wrong.

What are renewals and modifications?

Spanish law distinguishes between renewals and modifications of residence permits.

Renewal

A renewal extends the validity of your existing authorisation: non-lucrative residence, work permits, family reunification, student stays or exceptional-circumstances permits, among others.

Modification

A modification converts one type of status into another — for example, from student stay to work permit, from non-lucrative residence to self-employment, or from internship authorisation to employment.

These procedures are mainly regulated by the Immigration Organic Law and its Regulation, as amended by the 2024 reform, together with EU rules for researchers, students, entrepreneurs and EU Blue Card holders.

Key deadlines for renewals and modifications

Timing is critical. As a general rule, applications must be filed:

  • Within the 60 days before your permit expires, or
  • Within the 90 days after expiry.

Filing late may trigger a sanctions procedure, but it does not automatically extinguish the right to renew. If you file within the allowed period, your previous permit is automatically extended until a decision is issued, so your legal status continues even if the administration takes months to answer.

General requirements for most renewals & modifications

Each permit has its own specific conditions, but in practice most renewals and modifications share a similar documentary core:

  • Full copy of a valid passport.
  • Current or previous residence card (TIE) and last resolution.
  • Updated empadronamiento (census registration).
  • Proof of sufficient financial means (employment, self-employment income, bank statements, pensions, IRPF records, etc.).
  • Public or private health insurance meeting legal standards, if required for your category.
  • Payment of the relevant administrative fees.
  • Schooling reports for dependent minors and integration reports where required.
  • Sworn translations and legalisation/apostille for foreign documents.
  • Supporting documents that justify the specific renewal or modification you are requesting.

Main types of residence-permit renewals in Spain

1. Renewal of employee work permit (cuenta ajena)

Renewals for employed workers can be granted for up to 4 years and are usually more flexible than the initial authorisation. They may be approved if:

  • The employment relationship continues with the same employer.
  • The worker has a new employer.
  • The worker has remained registered as a job seeker.
  • The contract ended for reasons beyond the worker's control.
  • The worker is a victim of gender-based or sexual violence.

In many cases, authorities also ask for schooling reports for minors and, where applicable, an integration report. For this type of renewal, positive administrative silence often applies if there is no decision within 3 months.

2. Renewal of self-employment work permit (cuenta propia)

Self-employed workers can usually renew for periods of up to 4 years if they can show:

  • Ongoing business activity.
  • Compliance with tax, Social Security and licensing obligations.
  • Economic viability of the business (accounts, invoices, client portfolio, etc.).

3. Renewal of non-lucrative residence

The non-lucrative permit is typically renewed for 2 years. Authorities focus on:

  • Sufficient financial resources for all family members, often well above the IPREM baseline.
  • Valid comprehensive health insurance.
  • Evidence of effective residence in Spain (usually more than 183 days per year).

4. Renewal of long-term and long-term EU residence

Long-term residence rights are indefinite, but the physical TIE card must be renewed every 5 years. Not renewing on time can lead to a fine but does not automatically extinguish the underlying right. Requirements are minimal: valid passport, fee payment and photograph.

5. Renewal of exceptional-circumstances permits

Arraigo, humanitarian and public-interest permits are usually renewed for 1 year (up to 5 years in some Family Arraigo cases). Authorities check whether the circumstances that justified the original authorisation still exist, and may ask for:

  • Evidence of active job search or continued employment.
  • Registration with public employment services.
  • Schooling reports for minors.

6. Renewal of family-reunification permits

Family-reunification permits are commonly renewed for 4 years, provided that:

  • The family relationship and cohabitation (where applicable) continue.
  • Both sponsor and family member keep valid residence.
  • Schooling and integration requirements are met.

Modifications: changing to a new type of permit

Modifications allow you to move from one immigration category to another when your situation changes. Typical examples include:

  • Student stay → residence and work permit.
  • Non-lucrative residence → self-employment.
  • Internship authorisation → employment.
  • Family-based permits → independent residence in your own right.

Duration of the new permit after modification

  • If you had less than 1 year of prior residence, the new permit is usually granted for 1 year.
  • If you had a permit that already allowed you to work for more than 1 year, the new permit is often issued for up to 4 years.
  • If you had a permit that did not allow working, the new work permit is typically granted for 1 year from Social Security registration.

Restrictions

Some permits cannot be modified directly, such as cross-border authorisations or certain exceptional-circumstances permits, unless specific rules allow it. In these cases, you may need to plan a different route (new initial permit, arraigo, long-term residence, etc.).

Modifications during the first year

During the first year of an initial authorisation, the Immigration Office may modify:

  • The sector or occupation.
  • The geographical scope of the work permit.

If you request such a modification, the administration generally has 1 month to decide, and lack of response within that time often means positive silence.

Extensions of student stays, mobility and training authorisations

Student stays and training-based permits can usually be extended when:

  • The course or research activity continues.
  • The conditions remain equivalent to those that justified the initial authorisation.
  • You submit the application within the 60 days before expiry.

Filing on time extends the validity of the current authorisation until a decision is issued, which is particularly important when planning exams, internships or research milestones.

Effects of filing and administrative deadlines

Automatic extension

When you submit a renewal or extension within the legal period, your previous authorisation remains valid until the administration issues a decision. This avoids gaps in your legal status and usually allows you to keep working or studying.

Positive administrative silence

For many renewals and authorisation extensions, lack of a decision within 3 months is treated as approval. There are exceptions (for example, some visas and special permits), so it is important to know whether positive silence applies to your case before relying on it.

Appeals

Renewal or modification decisions normally bring the administrative route to an end. You may then file an administrative appeal or directly challenge the decision before the courts, depending on the case and the strategic value of each option.

Obligations after approval

  • Apply for or renew your TIE card within 1 month of approval.
  • Maintain the conditions that justified the permit (employment, income, insurance, schooling, etc.).
  • Submit future renewals or modifications within the legal deadline.

If a renewal or modification is finally denied, you are expected to leave Spain, but this does not automatically create a future entry ban. In many cases, it is possible to design a different route or reapply once the reasons for refusal have been corrected.

Required documentation — quick summary

Although each case is unique, most renewal or modification files will include:

  • Passport (full copy) and current/previous TIE.
  • Updated empadronamiento certificate.
  • Proof of income or financial means appropriate for your permit type.
  • Health insurance, where legally required.
  • Payment receipts for administrative fees.
  • Specific evidence supporting the renewal or modification (work contracts, business documentation, academic certificates, etc.).
  • Schooling reports for minors and integration reports where requested.
  • Sworn translations and apostilles/legalisations for foreign documents.
